The constitution and Presidential Ineptitude

The January 6th insurrection, riot or revolt was full sanctioned by then President Trump. People died and were murdered in the riot that ensued. Yes the participants had a choice and they exercised the same choice. That is irrelevant. It fact it violates the entire constitution. Starting at Article 2 section 3 which prohibits absolutely any traitorous or high crime ( felony ) or misdemeanor act by any member of the US government.or they shouldn't be in government at all.  The terms high crimes and misdemeanors influence companies like the federal government and private companies like Walmart in their hiring practices. 
As a long time public defender and prosecutor, these are daily terms that affect Joe.Average American. They should apply to the President of the Republic as well and do.  

The executive branch under Article 1 has no special exclusions from prosecution.Further the US code has no exclusion for the executive and legislative branch having immunity from prosecution. Trump lied and continues to lie leaving both America and her citizens at risk for war, invasion or further constitutional transgressions. 
The quorum requirement in the constitution is to prevent executive over reach. Agencies are supposed to act as a buffer from a corrupt and dangerous executive.  England didn't have that protection and some Kings and Queens were violent to the point of execution of its people. Hence the Bill of Rights. 

Beyond the Bill of Rights come the other constitutional amendments and basic American history. Problems arise, then the constitution was amended. At issue for this article are the 14th and 25th Amendments. The 14th  which I will insert below.

Article II talks about high crimes and misdemeanors. Misdemeanors generally have a sentence of a year or less felonies have a sentence longer than a year. This is established by Congress and the state congresses as well. 

The Fourteenth Amendment presents kinds of high crimes presented against the United States and assumably is designed to prevent an leader in the executive or legislative branch from inciting a coup or starting a rebellion based on personal pique.

Constitutional travesty

The Founders understood that monarchy too often developed a problem with people expressing themselves whether through religion, political view, land holding or other wealth. They also liked holding on to wealth in the "public interest." That might be where anti historical and indeed fascist influences reach American politics today.  Certain Trump is ignorant of history and hopelessly ignorant of both foreign relations and interior politics and structure. By this I means he has no idea of the division of powers or that he theoretically is Article One and that he's violating the 14th and 25th Amendments.    Whether he cares or not is another question.
